Ecologically sensitive areas within the Conservancy include the Klein Jukskei River, two wetland systems delineated by Chartwell Country Estates (CCE) in 2013, all open space grasslands and Critical Biodiversity Areas and Ecological Support Areas.
Critical Biodiversity Areas (orange areas) and Ecological Support Areas (yellow areas) are defined in the Gauteng Department of Agriculture and Rural Development Conservation Plan.
The ecologically sensitive areas are protected under the National Environmental Management Biodiversity Act 10 of 2004, National Environmental Management Act 107 of 1998, and the National Water Act 36 of 1998.
Development within the ecologically sensitive areas is not prohibited but is subject to additional development planning approvals including the need for an Environmental Impact Assessment (EIA).
GDARD must issue an Environmental Authorisation before proceeding with just about any development that is:
- within 32m of the edge of a watercourse (wetland, dam, river etc.)
- within a Critical Biodiversity Area or Ecological Support Area
- involves removal of 300m2 of indigenous vegetation (regardless of the presence of alien/invasive plant species)
